In summary. Impulse 3D Planner is an online service that Impulse Fitness México (“Impulse México”) offers by subscription to authorized Impulse distributors. It costs USD 65 per month or USD 715 per year (one month free); for distributors with a tax domicile in Mexico, VAT (IVA) is added and Impulse México issues them a CFDI (Mexican e-invoice). There is a 7-day free trial starting when Impulse México approves the account. You can cancel at any time. If a payment fails, you have a 5-day grace period, then 7 days to download your information, and we keep it for another 60 days before deleting it.

This summary does not replace the full text.

1. Who we are and acceptance

The Service is provided by Mario Iglesias Rivero, an individual engaged in business activities (persona física con actividad empresarial) operating under the trade name Impulse Fitness México (“Impulse México”), domiciled at Carretera Federal Puebla–Atlixco 9012, San Francisco Acatepec, San Andrés Cholula, Puebla, C.P. 72846. The platform was designed and developed by Vixionere, S.A.P.I. de C.V. (“Vixionere”), which operates it as the technology provider of Impulse México.

By requesting access, creating an account, checking the acceptance box or using the Service, the Distributor accepts these Terms. Anyone accepting on behalf of a company represents that they have the authority to bind it.

2. Definitions

3. The Service

The Service is used in a web browser; no software installation is required. It includes, among other features:

Impulse México may improve, add or remove features. If it removes an essential feature during a paid period, it will give 30 calendar days’ prior notice.

4. Who may subscribe

The Service is intended for authorized Impulse distributors and for their commercial activity. Access is requested on the website and Impulse México approves or rejects it at its discretion; it may request information or documents evidencing the distribution relationship. The Distributor represents that the information it provides is true and undertakes to keep it up to date.

If the Distributor ceases to be an authorized distributor, Impulse México may terminate the subscription with 30 calendar days’ notice; in that case, it will refund the unused pro rata portion of an annual plan.

5. Account, users and roles

Each account has at least one administrator, who registers Users with the available roles: administrator, sales manager, salesperson and operations. The salesperson cannot see costs. There is no additional charge for team Users.

The Distributor is responsible for passwords, for the access it grants and for the actions of its Users. It must immediately notify sales@impulsefitness-planner.ai if it detects any unauthorized use.

In the account settings, the Distributor enters its trade name, tax information, website, address, telephone and email, as well as the email and telephone that will receive its prospects’ designs. Designs that arrive through its link are delivered only to its account; they are not shared with other distributors.

6. Free trial

The trial lasts 7 calendar days and begins when Impulse México approves the account and the Distributor registers a payment method. One trial is granted per Distributor.

If the Distributor does not cancel before the trial ends, the plan it selected is charged on the following day and the subscription renews automatically. A reminder is sent by email before the trial ends.

7. Plans and prices

PlanPriceRenewal
MonthlyUSD 65.00 per monthAutomatic, every month
AnnualUSD 715.00 per year (11 months: one month free)Automatic, every year

8. Billing and invoicing

Charges are made to the Distributor’s card through Stripe, a payment processor. The Distributor authorizes the recurring charges for its plan. Impulse México and Vixionere do not store the full card number.

For Distributors with a tax domicile in Mexico, Impulse México issues the CFDI (Comprobante Fiscal Digital por Internet, the Mexican digital tax invoice) for each payment. For this purpose, the Distributor enters in its account its RFC (Mexican taxpayer ID), name or corporate name, tax regime, postal code and CFDI use; if that information is incorrect, the CFDI will be issued with it, and any correction will be subject to SAT rules. Distributors in other countries are provided with the receipt that corresponds under the applicable tax provisions.

From the payment portal, the Distributor can change cards, change plans, view its receipts and cancel.

9. Included usage limits

So that the price can be maintained, each account includes the following limits. When a limit is reached, the Platform gives notice and the feature resumes on the first day of the following month; the rest of the Service continues to operate.

FeatureIncluded limit
CRM and Inventory AI assistant (team queries)1,500 queries per month per account
Lead generation on Google Maps20 searches per month per account, of up to 60 businesses each
Copilot and “Design with AI”40 queries per day per person
Team users and prospectsUnlimited

Impulse México may adjust these limits with 30 calendar days’ notice. Circumventing them through duplicate accounts, automated programs or use of the account by third parties is prohibited.

10. Non-payment

If a charge is declined:

  1. Grace period of 5 calendar days. The Service remains active and a notice is sent by email to the administrator each day so that they update the payment method and complete the payment from the portal.
  2. Suspension with 7 calendar days to download. If payment is still pending at the end of the grace period, the account is suspended: the link stops receiving new designs and Users can no longer create or edit. For 7 calendar days, the administrator may download the account’s projects, CRM and inventory. If payment is made within that period, the account is fully reactivated.
  3. Retention for 60 calendar days. Once the 7 days have elapsed, access is closed. Impulse México retains the information for 60 calendar days for clarifications or a reactivation, and then deletes it securely, except for information that the law requires to be retained, such as tax information.

11. Cancellation and termination

The Distributor may cancel at any time from the payment portal or by writing to sales@impulsefitness-planner.ai. Cancellation prevents the next renewal; the Service remains active until the end of the period already paid. There are no pro rata refunds, except as provided in the Cancellation and Refund Policy or by law.

When the paid period ends, the same periods as in section 10 apply: 7 calendar days to download the information and 60 calendar days of retention before it is deleted.

Impulse México may suspend or terminate the account, with notice by email, if the Distributor seriously breaches these Terms, uses the Service unlawfully or jeopardizes the security of the Platform or of other users.

12. Acceptable use

The Distributor and its Users undertake not to:

13. Data of the Distributor and its prospects

The Distributor Data belongs to the Distributor. The Distributor may download it at any time while its account is active and within the periods set out in sections 10 and 11.

With respect to the personal data that the Distributor enters in its CRM or inventory, or that it receives from the prospects who reach it through its link, the Distributor is the data controller under the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (Federal Law on the Protection of Personal Data Held by Private Parties): it must have its own privacy notice, obtain the applicable consents and respond to requests from the data subjects. Impulse México and Vixionere process such data as data processors, solely to provide the Service, with security measures and without using it for their own purposes.

Prospects’ accounts on the Platform are governed by the Impulse México Privacy Notice. A prospect’s design and contact details are delivered to the Distributor whose link the prospect used; if the prospect arrived without a link, they are received by Impulse México, which may assign the prospect to a distributor.

Impulse México may use aggregated and anonymous information, which does not identify the Distributor or any individual, for statistics and to improve the Service.

14. Artificial intelligence and estimates

The copilot, “Design with AI”, the gym analysis and the assistants use third-party artificial intelligence models. Responses may contain errors. Capacity, occupancy and audience figures are calculated using formulas and assumptions that the user can change: they are estimates, not forecasts or guarantees.

The Service does not replace professional advice in architecture, structural or electrical engineering, medicine, finance or any other field. Before quoting or installing, the Distributor must verify on site the dimensions, structure, building services and conditions of the space.

15. Catalog, dimensions and 3D models

The catalog is the Impulse international catalog and is the same for all distributors. Dimensions are taken from the catalog; the 3D models are generated from photographs and may differ in details from the actual product. The availability, prices, delivery times, warranties and installation of whatever the Distributor offers to its customers are the responsibility of the Distributor.

16. Intellectual property

The software, design, code, catalog, 3D models, texts and the “Impulse” and “Impulse 3D Planner” trademarks belong to Impulse México, to Vixionere or to their licensors. During the subscription, the Distributor receives a non-exclusive, non-transferable and revocable license of use, limited to its activity as a distributor.

The Distributor authorizes Impulse México to display its trade name, logo and contact details within the Platform, on the flyer and in the documents generated by its prospects, solely for the purpose of providing the Service.

17. Availability and support

Impulse México endeavors to keep the Service available at all times, but does not guarantee that it will operate without interruptions or errors. There may be maintenance periods, preferably outside Mexico City business hours and with prior notice when scheduled. Support is provided by email at sales@impulsefitness-planner.ai, on Mexico City business days and during business hours.

18. Liability

Neither party shall be liable for indirect damages, lost profits or loss of business opportunities, except in cases of willful misconduct (dolo) or bad faith. The total liability of Impulse México to the Distributor for any cause related to the Service is limited to the amount paid by the Distributor in the 12 months preceding the event giving rise to such liability, to the extent permitted by law.

19. Confidentiality

Each party shall keep confidential the non-public information it receives from the other party, during the subscription and for two years thereafter, except when required by a competent authority.

20. Changes to these Terms

Impulse México may amend these Terms. Changes are published on this page with their date and notified by email at least 30 calendar days in advance. If the Distributor does not agree, it may cancel before they take effect; continued use of the Service thereafter constitutes acceptance.

21. Electronic means

The parties agree to contract and communicate by electronic means. Acceptance of these Terms by electronic means has the same validity as a handwritten signature, in accordance with the Código de Comercio (Commercial Code) and the Código Civil Federal (Federal Civil Code). Notices to the Distributor are sent to the email address of the account administrator.

22. Governing law and jurisdiction

These Terms are governed by the federal laws of the United Mexican States. For their interpretation and performance, the parties submit to the competent courts of the city of Puebla, Puebla, and waive any other jurisdiction to which they may be entitled by reason of their present or future domicile.
